The judicial and extra-judicial defence of consumers’ rights is a key element to ensure a balanced position in the financial market. In addition to studying injunction actions, we also give importance to extra-judicial processes to resolve conflicts.
Consequently, the European Commission, through their recommendations related to the bodies responsible for extra-judicial solutions of conflicts affecting consumers, clearly prefers official governing bodies, that is, governing bodies where consumers’ and companies’ representatives have their say, in order to guarantee impartial decisions.
In any case, consumers’ participation in extra-judicial systems to resolve conflicts has been repeatedly claimed for by the Parliament and the European Commission through several Recommendations and Communications, as well as through the conclusions of the Green Book about consumers access to justice and dispute solutions in the single market.
